Are You Being Called By Worldwide Asset Purchasing, LLC?*

Are you being called by Worldwide Asset Purchasing, LLC?* Here’s what you need to know.

There are many reasons why people fall into debt, and not all of them involve financial irresponsibility. Layoffs, illness, disability, and other setbacks can all send accounts that you formerly paid faithfully into arrears. This is when creditors will assign them to third-party debt collectors who will spare no effort to get you to pay. It is important to remember that you have rights that make treating you in an abusive manner illegal.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act (FDCPA) limits what third-party debt collectors and collection agencies can do while attempting to collect a debt from you. Actions like the following are strictly prohibited.

  • Using profane and obscene language
  • Ignoring a formal request to cease communications
  • Threatening consequences they cannot legally inflict, or have no intention of carrying out
  • Discussing the debt with anyone except you, your spouse, or your attorney
  • Calling at all hours of the day and night
  • Claiming that you owe an amount that’s not supported by law or the original creditor agreement

Alleged Violations against Worldwide Asset Purchasing, LLC

According to PACER, in or around 2005, Worldwide Asset Purchasing, LLC sued an Alabama resident to collect a debt and obtained a default judgment. She later claimed that she first became aware of the judgment when a process of garnishment was served upon her ex-husband at his home in October 2014. Upset, the consumer called the agency’s law firm and informed them that she was now divorced and to cease any further communications with her ex-husband. Nonetheless, on or about December 10, 2014, Worldwide Asset Purchasing, LLC, allegedly sent another letter to her ex-husband’s address, this one divulging her personal affairs.

Feeling harassed by Worldwide Asset Purchasing, LLC, the consumer hired a consumer attorney and sued the company for allegedly violating the FDCPA by communicating with an unauthorized third party about the debt.

The matter was later dismissed.
