According to information on the PACER website, in or around December 2004, Turnbrook Associates, Inc. began trying to collect a debt from a Pennsylvania consumer. She claimed that on or around January 6, 2005, a collector who identified herself as Mrs. David contacted her mother and revealed details about the debt.

This conversation was allegedly followed by another one, this one between Mrs. David and the consumer, on or about January 7, 2005. When the consumer said she could not pay off the debt, Mrs. David allegedly told her that she should “file bankruptcy before we sue you in Superior Court and place a judgment on your permanent record which will remain on your credit report for 20 years.”

Feeling harassed by Turnbrook Associates, Inc., the consumer took action by suing the company for:

  • Using harassing and abusive means to collect a debt
  • Using false, deceptive, and misleading means to collect a debt
  • Using unfair and unconscionable means to collect a debt

A judgement was entered in favor of the plaintiff.
