Are You Being Called By RentCollect Global?*

Are you being called by RentCollect Global?* Here’s what you need to know.

Debt collectors have an uncanny ability to catch you completely off-guard. When you’re not ready to deal with them, you can end up agreeing to a payment arrangement you can’t afford or getting into a verbal altercation that leaves you badly shaken. To protect yourself from either possibility, read up on your rights.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, protected indebted consumers by mandating that third-party debt collectors may not use methods like those below to collect debt payments from you.

  • Using profane and obscene language
  • Calling at all hours of the day and night
  • Telling your friends, neighbors and co-workers that you owe money and they are trying to collect it from you
  • Trying to collect an amount that is not authorized by law or the original creditor agreement
  • Calling you at work after you’ve told them that your employer doesn’t allow such calls
  • Leaving vague messages that do not identify the caller as a debt collector

Alleged Violations against RentCollect Global

According to PACER, in 2008 RentCollect Global started trying to collect a past due rental account from a Washington woman who had cosigned for a daughter. When she did not pay, collectors allegedly called her employer and asked for information about her payroll. The plaintiff was also called repeatedly: she claimed that once the agency allowed her phone to ring 25 times before hanging up.

Feeling harassed by RentCollect Global, she hired a consumer attorney and sued the company for allegedly violating the FDCPA in the following ways:

  • Using false, deceptive and misleading means to collect a debt
  • Discussing the alleged debt with third parties
  • Using unfair and unconscionable means to collect the debt
  • Using harassing and abusive mens to collect the debt

The matter was later settled.
