Are You Being Called By Professional Recovery Consultants?* Here’s What You Need to Know

It can be frustrating when a debt collector begins calling about an alleged debt. This frustration can be heightened if the calls are repeatedly occurring or are coming in at inconvenient times. If this is happening to you, then you may be able to file a claim to help stop the calls and receive compensation for the inconvenience.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, protects consumers from harassment by third-party collection agencies. Debt collectors are prohibited from using pressure tactics like the following to make you pay:

  • Calling you outside of the hours of 8:00 a.m. – 9:00 p.m.
  • Contacting you at work after you tell them to stop
  • Using profane or obscene language
  • Making legally insupportable threats,
  • Chasing you for a time-barred debt
  • Failing to identify themselves as debt collectors

Alleged Violations against Professional Recovery Consultants**

According to PACER, in or around October 2010, Professional Recovery Consultants started calling a North Carolina consumer to collect a debt. He complained that the company even called his mother-in-law’s number and said to the consumer “We can do what we want and can call whenever we feel like it”.
Feeling harassed by Professional Recovery Consultants, the consumer sued the agency for:

  • Calling him without always disclosing its identity
  • Using harassing means to collect a debt

The case was later dismissed.
