The letter, which was later submitted as an exhibit, stated that the couple had 10 days to pay the account in full or the debt would be recovered through legal action. A second letter, received on March 20, stated that C&D Complete Business Solutions intended to serve the Terrys’ employer with “legal documentation to garnish [their] wages.” This letter was actually sent, despite the fact that the agency had not obtained a judgment.
Feeling harassed by C&D Complete Business Solutions, the Terrys hired a consumer attorney and sued the company for allegedly violating the FDCPA by:
