Are you being called by C&D Complete Business Solutions?* Here’s what you need to know

When you lose your job, become too sick to work, or encounter another setback that impacts your income, debt that was once manageable can accumulate and cause you to fall into arrears. The stress gets worse when debt collectors call and send nasty letters. It is important to remember that no matter how much you owe, you do not have to tolerate mistreatment.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, dictates how third-party debt collectors may interact with consumers about debts they are alleged to owe. Approaches like the following are illegal and can lead to fines and other consequences.

  • Using profane or obscene language
  • Threatening to damage your reputation and credit rating
  • Refusing to validate the debt and prove that they are authorized to collect it
  • Telling you that you will be arrested, have your wages garnished, or be evicted
  • Making legal threats they have no intention of following up on
  • Pretending to be police officers or government agents

Alleged Violations against C&D Complete Business Solutions

Dwight Terry and Sabrina Terry vs. C&D Complete Business Solutions et al*

According to PACER, on March 4, 2009, Missouri residents Dwight and Sabrina Terry allegedly received a collection letter from C&D Complete Business Solutions regarding a $808 debt. The letter, which was later submitted as an exhibit, stated that the couple had 10 days to pay the account in full or the debt would be recovered through legal action. A second letter, received on March 20, stated that C&D Complete Business Solutions intended to serve the Terrys’ employer with “legal documentation to garnish [their] wages.” This letter was actually sent, despite the fact that the agency had not obtained a judgment.

Feeling harassed by C&D Complete Business Solutions, the Terrys hired a consumer attorney and sued the company for allegedly violating the FDCPA by:

  • Sending collection letters that overshadowed their dispute rights
  • Communicating with third parties about the debt
  • Using harassing and oppressive means to collect a debt
  • Using unfair and unconscionable means to collect a debt
  • Using false, deceptive and misleading means to collect a debt
  • Threatening action that could not legally be taken

The matter was later resolved.
