Are You Being Called By International Collection Agency, LLC?* Here’s What You Need to Know

If you’ve lost your job or become disabled and consequently fallen behind in your debt obligations, collection agencies will eventually be contacting you to demand payment of the arrears. Not all of them will be patient or civil but as a consumer you have rights that aggressive debt collectors ignore at their own professional risk.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, is a consumer protection law that protects you from being harassed by overzealous collection agencies. It prohibits actions like the following when used to collect or attempt to collect a consumer debt:

  • Using profane or obscene language
  • Demanding amounts not supported by law or the original creditor agreement
  • Calling you at work after you’ve told them that your employer doesn’t allow such calls
  • Calling you repeatedly and leaving messages that do not identify them as debt collectors
  • Claiming to be an attorney or a law enforcement official
  • Telling your friends, neighbors and co-workers that you owe money and they are trying to collect it from you

Alleged Violations against International Collection Agency, LLC

Tina Malave vs. International Collection Agency, LLC**

According to PACER, on or around February 10, 2016, International Collection Agency, LLC sent a collection letter to New Jersey resident Tina Malave. The letter read, in part,

“The events leading to this situation gave you ample consideration and opportunity to make voluntary arrangements for payment with our client. Please do not contact our client regarding this debt until the amount has been satisfied in full.”

Ms. Malave felt that this type of notice overshadowed her dispute rights. Feeling harassed by International Collection Agency, LLC, she hired a consumer attorney and sued the company for allegedly violating the FDCPA in the following ways:

  • Using false, deceptive, and misleading means to collect a debt
  • Using harassing and oppressive means to collect a debt
  • Using unfair and unconscionable means to collect a debt

The matter was later settled.
