  • using violence of any kind or any type of criminal behavior that causes physical injury to a debtor or damages his/her reputation;
  • has used threats in order to get its hands on your property;
  • has used threats to garnish your wages;
  • has used threatening tactics to get you arrested for non-payment of your debt;
  • has made public a debtors’ list and has threatened every member on the list with legal action.

Any debtor that is able to furnish proof of their cases in a court of law are eligible to be awarded $1,000 in statutory damages. Also the court may award actual damages, which include both physical and emotional damages, and compensation for lost income and wage garnishment.

The debt collector may also have to pay the debtor’s attorney fees. Typically physical damage awards cover ailments that are easy to prove such as rashes, serious headaches, and cardiovascular problems.
