Getting into debt isn’t something that anyone wants happening to them, but there are times when it might be inevitable. The creditor may not be willing to listen to excuses for defaulting on loan repayments and may hire a debt collection agency like Global Credit & Collection to collect your debt on their behalf.

It is bad enough being in debt, let alone having someone knocking on your door day and night or hounding you with telephone calls way past your bedtime. Fortunately, the U.S. federal government sees what trouble 3rd party debt collectors can cause to debtors and has in place a rule that prohibits debt collection agencies like Global Credit & Collection from trying to obtain a debt by making repeated and undesirable calls on a debtor.

What is the FDCPA?

The Federal Debt Collection Practices Act (FDCPA) is a federal law that disallows third party debt collection agencies like Global Credit & Collection from habitually harassing debtors to make them pay their debt.. It also stops debt collectors from using force or abusive language towards the debtor. If the debt collector acts in an unlawful manner the debtor may be able to sue the debt collector as long as the offence has taken place within 12 months of filing for damages.

What is and What is Not Acceptable Behavior From Global Credit & Collection

If the debtor has made arrangements to discuss the debt and repayments during unsocial hours there is nothing illegal about that.

If you feel you are being treated badly by the debt collector whether it is repeated visits in antisocial hours or constant phone calls you should firstly asking the person to stop. If they refuse to stop or even use threatening or abusive language you may have the right to file legal action against the person. You can insist damages are paid as compensation and you are not responsible for any legal fees. You must lodge the claim within 12 months of the occurrence of the event.

How an Attorney can Help

It is possible to file a damages claim on your own but you are far more likely to win a favorable settlement if you hire an attorney to work on your behalf. The attorney will know if the action that has taken place is illegal and if you are likely to win a favorable damages settlement for the way you have been treated by Global Credit & Collection.
