According to PACER, on or around December 20, 2008, World Credit Fund II, LLC had an Illinois couple served with a summons and complaint for an alleged credit card debt. The consumer had been notified about the debt in 2005 and disputed it at the time.

He requested verification and but heard nothing more until he was served with the summons and complaint.

At the time the case was filed, it was barred by the five-year Illinois statute of limitations for contracts not wholly in writing, there having been no payment or activity on the account for more than five years.

In addition, World Credit Fund II, LLC was allegedly not licensed as a collection agency and had no right to enforce delinquent consumer debts in Illinois.

Feeling harassed by World Credit Fund II, LLC, consumers sued the firm for allegedly violating their rights by:

  • Trying to collect a time-barred debt
  • Engaging in collection activity without verifying the debt

The matter was later dismissed.
