Called By Trans-Continental Credit & Collection Corp.?*

Are you being called by Trans-Continental Credit & Collection Corp.?* Here’s what you need to know

Literally thousands of people across the country are pursued by collection agencies. They owe money on their credit cards, student loans, and other obligations but, due to financial setbacks, are no longer able to make even the minimum payments. Unfortunately, they are also harassed and abused by phone and letter. If this happens to you, be aware that you have rights that protect you from such mistreatment.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act (FDCPA) protects consumers from third-party debt collectors who would otherwise harass them nonstop. It restricts what these collection agencies can do to collect a debt, so actions like those below are prohibited.

  • Calling you before 8:00 a.m. and after 9:00 p.m.
  • Calling you at work after you tell them that you can’t take personal calls there
  • Using profane or obscene language
  • Claiming that you can be arrested, have your assets seized, or have your wages garnished if you do not pay
  • Telling your friends, neighbors, and co-workers that you owe money
  • Leaving voice messages that do not identify the collector and the purpose of their call

LETS FACE FACTS- GOOD CREDIT IS IMPORTANT TO YOU….

UNLESS THIS BILL IS CLEARED BY RETURN MAIL, WE WILL BE OBLIGATED TO RECOMMEND TO OUR CLIENT THAT IT REPORT THIS DEBT TO THE VARIOUS CREDIT BUREAUS FOR GENERAL DISTRIBUTION AND AVAILABILITY. THIS CAN HURT YOUR ABILITY TO OBTAIN CREDIT FOR YEARS.

Ms. Masre took this to mean that if she did not pay this alleged debt, her future ability to obtain credit and a good credit standing would be jeopardized. Feeling harassed by Trans-Continental Credit & Collection Corp., she hired a consumer attorney and sued the company for allegedly violating the FDCPA in the following ways:
