Alleged Violations against Synerprise Consulting Services, Inc.

According to PACER, on or around April 2014, Synerprise Consulting Services, Inc. allegedly began placing collection calls to a Texas consumer. She later complained that none of these representatives identified the name of their company or stated that they were debt collectors.

During one conversation, a collector allegedly told her that there was “no statute of limitations on any form of debt collection” and threatened to sue her even though the debt was incurred outside the four year statute of limitations in Texas. The consumer also allegedly never received a debt validation letter within five days of its initial communication with her.

Feeling harassed by Synerprise Consulting Services, Inc., she hired a consumer attorney and sued the agency for allegedly violating the FDCPA in the following ways:

  • Indulging in harassing and abusive conduct
  • Using false, deceptive and misleading means to collect a debt
  • Failing to disclose itself as a debt collector in all communications
  • Threatening legal action it could not take
  • Failing to send a debt validation letter

The matter was later settled.
