Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, prohibits abusive debt collection tactics. No matter how much you may owe, you have a right to be treated with respect, and if you’re not, you then have a right to sue the debt collector. Examples of illegal tactics include:

  • Trying to collect when you refuse to pay
  • Yelling and swearing at you over the phone
  • Failing to send a debt validation letter within five days of first contacting you
  • Demanding payment for a debt discharged in bankruptcy

Alleged Violations against Specialized Loan Servicing

According to PACER, on or around February 18, 2014, Specialized Loan Servicing called an Indiana consumer to collect a debt. The call allegedly came after 9:00 p.m. at night and was followed by another call in April, this one at 9:38 p.m.

Feeling harassed by Specialized Loan Servicing, the consumer hired an attorney and sued the company for calling her after 9:00 p.m. in her time zone. The matter was later dismissed.
