According to PACER, on or about November 2, 2012, a Sentry Recovery & Collections, Inc. representative who identified herself as “Mrs. Lockett” called a Nevada resident at work.
When he returned the call, Mrs. Lockett stated her company had been hired to collect a debt he allegedly owed to an apartment building. She allegedly added that if he didn’t work something out with Sentry Recovery & Collections, Inc. immediately, his wages would be garnished. He said he could not talk at work, did not believe that he owed the debt she was collecting, and to stop calling.
On November 6, 2012 at approximately 11:50 a.m., Mrs. Lockett allegedly called the plaintiff at work again and stated, “I expected you to call us. I don’t think you know how serious this is and you don’t understand what we can do to you…Do you understand me? Do you speak English?” When he reminded her that he could not have this discussion at work and to stop calling, Mrs. Lockett allegedly responded by threatening, “Next time I call you, I will be calling your human resources department to garnish your wages and if you want Sentry to stop the lawsuit and garnishment you need to come to our office and pay what you owe immediately.”
Later that day, another Sentry representative called at approximately 3:30 p.m. and allegedly stated, “[Sentry] will sue you and garnish your wages next Monday unless you arrange to pay the debt immediately.”
Feeling harassed by Sentry Recovery & Collections, Inc., he hired a consumer attorney and sued the company for allegedly violating the FDCPA in the following ways:
