Are You Being Called By RT Resolutions?*

Have you been harassed by a debt collector? Have they called your family to say that you owe money, used foul language, or threatened you with prison if you didn’t pay immediately? This conduct is illegal, so your next step should be to retain a consumer lawyer who will protect your rights.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act (FDCPA) was passed in 1977 to address abusive debt collection practices. It defines your rights, imposes guidelines for debt collector conduct, and prescribes penalties for violations like those below.

  • Swearing and using racist language
  • Calling you a criminal
  • Demanding amounts not supported by law or the original creditor agreement
  • Failing to identify themselves during each communication as a debt collector seeking to collect a debt
  • Calling you several times a day
  • Demanding that you pay immediately even though you are entitled to dispute

Alleged Violations against RT Resolutions

According to PACER, on or around July 21, 2014, RT Resolutions sent a demand letter to an Ohio couple requesting payment for a mortgage debt that had been rescinded in a 2005 court action.

Alarmed and feeling harassed by RT Resolutions, the consumers engaged an FDCPA lawyer sued the agency for allegedly:

  • Misrepresenting the legal status of the debt
  • Using harassing and abusive means to collect a debt
  • Using false, deceptive, and misleading means to collect a debt

The matter was later dismissed.
