Are You Being Called By Reliant Capital Solutions?*

According to a recent news story, two residents of Charlotte, North Carolina headed a debt collection scheme that scared consumers into paying them millions of dollars. Even though people tend to be savvier today, they can still run into situations where an unethical debt collector takes things too far.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, was passed over 40 years ago to protect consumers from being tricked or threatened into paying debts they did not owe or couldn’t afford. Today, any collection agency that uses pressure tactics like those below can be fined and even put out of business.

  • Failing to identify themselves as debt collectors seeking to collect a debt
  • Trying to collect when you refuse to pay
  • Calling you outside the hours of 8:00 a.m to 9:00 p.m. in your time zone
  • Contacting you directly when they know that you have an attorney
  • Refusing to provide you with information about the debt upon request
  • Adding illegal service fees to the original debt

Alleged Violations against Reliant Capital Solutions

According to PACER, in or around early 2012, Reliant Capital Solutions started calling a California consumer at his workplace to collect a debt. He told them not to call him there, but collectors allegedly continued to reach out to him at least twice a day.

The consumer also claimed that they used aggressive and bullying language with him, saying that they were marking his account as “refusal to pay” and putting him down “for non-compliance.”

Feeling harassed by Reliant Capital Solutions, the consumer hired an attorney to help him sue the company for:

  • Calling him at work after being told to stop
  • Using harassing and abusive means to collect a debt
  • Using false, deceptive, and misleading means to collect a debt
  • Using unfair and unconscionable means to collect a debt

The matter was later settled.
