Are You Being Called By RCS Centre Corp.?* Here’s What You Need to Know

In these difficult times, even the most financially responsible person can run into problems staying current with their debts. When this happens, a collection agency may be hired to collect any arrears. While collecting debt is legal, no company can bully, harass, or manipulate you into paying.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act (FDCPA) was passed in 1977 to address abusive debt collection practices. It defines your rights, imposes guidelines for debt collector conduct, and prescribes penalties for violations like those below.

  • Harassing you by phone (calling and hanging up)
  • Adding illegal service fees to the original debt
  • Harassing you over a debt that isn’t yours
  • Using an autodialer to call you
  • Threatening legal actions it has no intention of taking
  • Demanding payment for a debt discharged in bankruptcy

Alleged Violations against RCS Centre Corp.**

According to information on the PACER website, in or about July 2008, RCS Centre Corp. started contacting a Pennsylvania consumer to collect a debt. She complained that she received 10 to 14 calls a day, and that collectors left voice messages like “Lisa, I know you are there. Pick up” or “We know you work until 5:30 p.m. We will call your neighbors if you don’t call back.”

The consumer claimed that RCS Centre Corp. actually called her elderly neighbors on a number of occasions. She added that she provided the company with her home telephone number, because the cell phone it called was not hers. She was allegedly told, “We know you lied to us. That is your cell phone number and we will keep calling it.”

Feeling harassed by RCS Centre Corp., the consumer sued the agency for:

  • Using false, deceptive, and misleading means to collect a debt
  • Using harassing and abusive means to collect a debt
  • Making her debt information available to third parties

The matter was later dismissed.
