Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, was passed in 1977 to protect indebted consumers from harassment by third-party debt collectors. Under the FDCPA, a collection agency and its representatives may not use methods like the following to collect a debt.

  • Using profane and obscene language
  • Calling you before 8:00 a.m. or after 9:00 p.m. in your time zone
  • Calling you at your workplace when they know that your employer doesn’t permit you to take such calls
  • Telling uninvolved third parties like your friends and co-workers that you owe money
  • Demanding an amount that is not supported by law or the original debt agreement

Although illegal, activities like these continue to be used by debt collectors who hope that you won’t know enough about your rights to report the harassment.

Alleged FDCPA Violations

In 2008 a Maryland resident began getting calls from Praxis Financial Solutions Inc about a personal debt it had been assigned to collect. When she insisted that she disputed the debt, one caller allegedly told her she had no right to do so.

When the calls allegedly continued, she hired a consumer attorney and sued Praxis Financial Solutions Inc for the following alleged FDCPA violations:

  • Using false, deceptive and misleading means to collect a debt
  • Failing to disclose her right to dispute the debt
  • Failing to provide her with a debt validation notice

The matter was later dismissed.
