Stop the
Harassment

You have legal rights. We can help.

Is a debt collector determined to harass you and make your life difficult? If they tell you that the law entitles them to treat you in this manner, don’t believe them. There are federal statutes in place that prohibit the bullying and harassment of consumers, and any collection agency that behaves otherwise can face serious penalties.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, was passed in response to growing concerns about consumers being made ill or insolvent by third-party collection agencies. This consumer protection law makes it illegal to use tactics like those below to collect your money.

  • Leaving voice messages that don’t reveal the reason for the call
  • Demanding that you pay a debt you never incurred in the first place
  • Refusing to prove that a debt is valid and they are authorized to collect it
  • Making your debt information available to uninvolved parties
  • Making racist or sexist comments
  • Calling you names

Alleged Violations against One Main Consumer Loan, Inc.

According to PACER, in March 2017, One Main Consumer Loan, Inc. began contacting a New Jersey consumer to collect a debt. She claimed that in April, debt collectors started calling her at work, disguising themselves as either family members or individuals seeking to procure services related to her line of work.

After contacting her through this ruse, they would allegedly demand payment. When she told them to stop calling, they allegedly ignored her and one aggressive call was allegedly followed by a text disparaging her for refusing to answer or address calls concerning her debts.

Feeling harassed by One Main Consumer Loan, Inc., she hired an attorney and sued the company for allegedly violating her rights by:

  • Calling her constantly
  • Calling her at work after being asked to stop
  • Calling her without disclosing their true identity

The matter was later dismissed.
