According to PACER, on or around November 19 2010, KevMar Capital Corporation filed a collection lawsuit against an Arkansas consumer to collect a credit card debt. He alleged that he received no collection notices from the company before the lawsuit was initiated and that excessive fees were attached to the claim.

Feeling harassed by KevMar Capital Corporation, the consumer filed an FDCPA lawsuit against the agency for:

  • Using false, deceptive, and misleading means to collect a debt
  • Demanding an amount not supported by law or the original creditor agreement
  • Misrepresenting the character and amount of the debt

The matter was dismissed.
