Are You Being Called By JM Adjustment Services, LLC?*

When people fall behind on their monthly debts, financial irresponsibility is not always the issue. In many instances they lose their jobs, become disabled or too sick to work full time, or become divorced and have to pay alimony and / or child support. Unfortunately, the debt collectors assigned to collect their overdue accounts often harass them for payment, ignoring the fact that indebted consumers have rights.

Your Rights Under the FDCPA

At one time, people were declaring personal bankruptcy solely to escape from abusive debt collectors. In 1977 Congress passed the Fair Debt Collection Practices Act, or FDCPA, to stop the use of harassing and deceptive methods like those below.

  • Using profane and obscene language
  • Refusal to provide you with information about the debt
  • Trying to collect amounts that exceed the original debt
  • Calling at inconvenient times, such as before 8:00 a.m. and after 9:00 p.m. in your time zone
  • Demanding more than you owe under the original credit agreement
  • Threatening legal action they have no intention of taking

Alleged Violations against JM Adjustment Services, LLC

Nicole Patterson, on behalf of herself and all others similarly situated vs. JM Adjustment Services, LLC*

According to PACER, during the month of January 2014, North Carolina resident Nicole Patterson could not make her regularly-scheduled Chase home mortgage payment, and notified the company that her payment would be late that month.

On January 26, 2014, JM Adjustment Services, LLC sent a representative to drop off a packet of information regarding her Chase mortgage at her residence. The next day a representative taped a letter to Ms. Patterson’s front door and rang the doorbell. She opened the door and spoke to this person, who allegedly stated she was with the bank and appeared to be inspecting the property to note its value. After being told to leave, this party allegedly took a photo of Ms. Patterson standing at the front door.

On January 31, 2014, JM Adjustment Services, LLC sent Ms. Patterson a letter regarding the debt to Chase. It stated, in part:

On 01/27/2014, we, on behalf of Chase, made or attempted to make contact with you to encourage you to contact Chase. We are not collecting that debt nor are we demanding any money, so, any questions you may have regarding the debt should be directed to Chase….

The purpose of this letter is to provide you with Important Consumer Information regarding certain rights afforded you under the law.

Sincerely,

J.M. Adjustment Services, LLC

Ms. Patterson felt that the agency’s conduct, including the sending of the letter, went beyond mere information gathering or message delivery, and instead constituted collection activity. Feeling harassed by JM Adjustment Services, LLC, she hired a consumer attorney and filed a class action lawsuit against the company for allegedly violating the FDCPA in the following ways:

  • Using false, deceptive and misleading means to collect a debt
  • Failing to identify themselves as debt collectors in all communications

The matter was later settled.
