Biko Burrell vs. Imperial Recovery Partners, LLC*

According to PACER, in or around early 2011, Imperial Recovery Partners, LLC started calling Michigan resident Biko Burrell about an alleged debt. In February, 2011, Mr. Burrell asked the company to stop calling him and asked for the debt to be verified in writing. The caller allegedly responded by saying, “No, we are not going to do that.”

In another phone conversation, on or about March 17, 2011, a collector named ‘James’ allegedly told Mr. Burrell, “I am going to type in the computer your refusal to pay and send this account back to Wells Fargo. Wells Fargo will garnish your wages.” He responded that he had retained an attorney regarding the debt and provided contact details. The alleged response was “Your attorney cannot do anything about this.”

The following week, on March 25, 2011, Imperial Recovery Partners, LLC allegedly called Mr. Burrell again. He insisted, “I already told you I have an attorney.” The caller allegedly said, “I don’t care who you have, you owe a debt,” before hanging up.

Feeling harassed by Imperial Recovery Partners, LLC, Mr. Burrell hired a consumer attorney and sued the company for allegedly violating the FDCPA in the following ways:

  • Contacting him directly despite knowing that he had an attorney
  • Using harassing, oppressive, and abusive means to collect a debt
  • Using unfair or unconscionable means to collect a debt
  • Failing to send a debt validation notice

Imperial Recovery Partners, LLC had to pay Mr. Burrell $769.31 in attorney’s fees and costs incurred as a result of Defendant’s failure to comply with his subpoena.
