Alleged Violations against Huntington Debt Holdings, LLC

According to PACER, in or around May 22, 2017, a representative of Huntington Debt Holdings, LLC allegedly called a Minnesota consumer to collect a payday loan debt that had been discharged in a Chapter 7 bankruptcy filing.

The caller allegedly left a voicemail identifying them as “an advocate for the Pierce County District Court.”

Two more calls followed within an hour of the first one. In one message, the caller allegedly stated that if she didn’t call back, a service summons would be sent to her place of employment and would have to be signed for by both the consumer and her supervisor.

When the consumer called back to state that the debt had been discharged in bankruptcy, the representative allegedly told her that it was aware of her bankruptcy but charged had been filed against her much earlier, so the payday loan debt would not have been discharged.

Feeling harassed by Huntington Debt Holdings, LLC, the consumer retained legal counsel and sued the agency for allegedly:

  • Using false, deceptive, and misleading means to collect a debt
  • Failing to identify itself as a debt collector in all communications
  • Using harassing and abusive means to collect a debt

The matter was later dismissed.
