Are You Being Called By Hewitt Capital LLC?

People fall into serious debt for a number of understandable reasons, such as illness or job loss. Once an account is delinquent, however, your creditors will usually assign them to debt collectors who can make your situation even worse if you don’t know your rights.

Your Rights Under the FDCPA

While collection agencies are legally allowed to contact you about a debt, the Fair Debt Collection Practices Act (FDCPA) prohibits them from using harassing and unprofessional actions like the following:

● Using profane and obscene language
● Threatening harm to your person, property, and / or credit rating
● Discussing your debt with your friends, neighbors, and co-workers
● Failing to identify themselves as debt collectors
● Reporting false information to the credit bureaus
● Threatening action they are not in a position to legally take

Alleged Violations against Hewitt Capital LLC

According to PACER, on or around July 12, 2018, Hewitt Capital LLC called an Indiana consumer to collect a debt and allegedly told her that they were referencing her “direct involvement in a legal matter” that was “scheduled to be referred to Morgan County.” The caller also allegedly told her that she had to “give a statement today” and that there were legal proceedings against her social security number.

Feeling harassed by Hewitt Capital LLC, the consumer got a free case review from a consumer lawyer and sued the company for:

● Threatening legal action it did not intend to take
● Trying to deceive her into paying
● Implying that she had committed a crime

The matter was later settled.
