Are You Being Called By H&R Accounts, Inc.?*

Debt collection is big business in the US. An estimated 30 million consumer debts are assigned to collection agencies every year, resulting in over one billion collection contacts. It’s safe to assume that many of these contacts are less than stellar, as debt collectors don’t have the best reputation.

Your Rights Under the FDCPA

A consumer protection law called the Fair Debt Collection Practices Act, or FDCPA, became law in 1977. It prohibits intrusive debt collection tactics like those below and gives you the standing to sue an agency that uses them.

  • Claiming to be police officers or federal agents
  • Ignoring a written cease communications request
  • Calling you before 8:00 a.m. and after 9:00 p.m. in your time zone
  • Refusing to send you a debt validation letter
  • Demanding that you pay a time-barred debt
  • Using aggressive and abusive language

Alleged Violations against H&R Accounts, Inc.

According to PACER, in or around July 24, 2018, an Illinois consumer checked his credit report and found an entry from H&R Accounts, Inc. He did not recognize it, so he called the agency for more information.

The representative told him that he owed a medical debt of over $1,600 from 2012, but in Illinois debts are time-barred after five years, making the debt legally uncollectible.

Feeling harassed by H&R Accounts, Inc., the consumer filed an FDCPA lawsuit against the company for the following alleged violations:

  • Trying to collect a time-barred debt
  • Using false, deceptive, and misleading means to collect a debt
  • Using unfair and unconscionable means to collect a debt

The matter was later dismissed.
