Alleged Violations against Genesis Credit Management, LLC

According to PACER, in the spring of 2015 Genesis Credit Management, LLC allegedly started calling an Arizona woman to collect a debt. She asserted that they called with such frequency that the obvious intent was to annoy and harass her.

On or around June 23, 2015, a collector called her at her workplace: when she stated that she was represented by lawyer, the collector allegedly insinuated that the company was going to garnish her wages, stating that it was going to obtain repayment of the debt “either way.”

Feeling harassed by Genesis Credit Management, LLC, she hired a consumer lawyer and sued the company for allegedly violating the FDCPA in the following ways:

  • Harassing her by phone
  • Using harassing and abusive means to collect a debt
  • Using false, deceptive and misleading means to collect a debt
  • Threatening legal action it has no intention of taking

The matter was later settled.
