Are you being called by Financial Data Systems, LLC?* Here’s what you need to know

Every year the Federal Trade Commission receives thousands of complaints about debt collectors harassing people. In some instances, they are chasing the wrong debtor and refuse to let up. In others, they are being rude, condescending, and relentless by calling the consumer every day and even talking about their debt to friends, family, and coworkers. If you find yourself being pursued by such a collection agency, read on to learn more about your rights.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, was passed in 1977 to protect consumers from being driven to bankruptcy by unethical debt collection practices. It regulates what third-party debt collectors can do when communicating with you, and prohibits actions like those below.

  • Failing to identify themselves during each communication as a debt collector
  • Telling your friends, neighbors, and co-workers that you owe a debt
  • Calling you at work after being informed that the workplace does not allow non-business calls
  • Calling at inconvenient times, such as before 8:00 a.m. and after 9:00 p.m.
  • Threatening legal actions that they have no intention of taking
  • Reporting false information to the credit bureaus
