Is Finance System of Green Bay Inc Calling You?*

Is Finance System of Green Bay Inc. calling you?* Here’s what you need to know.

Debt collectors are not always pleasant or even civil when they’re after your money. They may call you at work, imply you have committed a crime by not paying, and may even start swearing when you don’t hand over your checking account number. You have the right to make them stop, thanks to the FDCPA.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act (FDCPA) was enacted in 1977 to stop third-party debt collectors from using threats, harassment, and other unethical means to bully money from consumers. Under the FDCPA, collection tactics like the following are illegal:

  • Demanding outrageous amounts that exceed the amount of the original debt
  • Using profane or obscene language
  • Calling at inconvenient times, such as before 8:00 a.m. and after 9:00 p.m. in your time zone
  • Threatening action they cannot legally take or have no intention of taking
  • Discussing the debt with anyone except you, your spouse, or your attorney

Alleged Violations against Finance System of Green Bay Inc.*

Finance System of Green Bay Inc is a debt collection agency located in Green Bay, Wisconsin. It was founded in 1980, has fewer than 10 employees, and is managed by its President, Roger Schavlik. Records held at the PACER (Public Access to Court Electronic Records) website confirm that the company has been accused of violating the FDCPA over the years.

On or about March 16, 2015, a Wisconsin resident received a collection letter from Finance System of Green Bay Inc. regarding a debt allegedly owed to an apartment rental agency. The letter, which appeared to be a form letter generated by a computer, stated that the interest owed was ‘$0.00’ but implied that there could be “prejudgment interest” added to the debt if the plaintiff did not pay.

Since this implication was in a form letter that Finance System of Green Bay Inc would have sent to other consumers, the plaintiff hired a consumer attorney and initiated a class action suit against the company for these alleged FDCPA violations:

The matter was later settled.
