Your Rights Under the FDCPA

  • Calling you before 8:00 a.m. and after 9:00 p.m.
  • Calling you at work after you tell them that you can’t take personal calls there
  • Using profane or obscene language
  • Claiming that you can be arrested, have your assets seized, or have your wages garnished if you do not pay
  • Telling your friends, neighbors, and co-workers that you owe money
  • Leaving voice messages that do not identify the collector and the purpose of their call

She alleged that the various callers identified themselves as attorneys and did not always present themselves as debt collectors seeking to collect a debt. The consumer also complained that collectors used abusive language and called her at work despite being asked to stop.

Feeling harassed by Evans Law Offices, the consumer took legal action against the firm for:

  • Using harassing and abusive means to collect a debt
  • Using false, deceptive, and misleading means to collect a debt
  • Using unfair and unconscionable means to collect a debt
  • Harassing her by phone

The matter was later settled.
