Are You Being Called By Delta Outsource Group, Inc.? Here’s What You Need to Know*

Financial problems are a major source of stress, especially when you can barely make it from paycheck to paycheck. When you fall behind in your debt payments, it gets even worse because debt collectors soon get involved. However, if the collector is rude and intent on harassing you, remember that consumers do have rights no matter how much money they owe.

Your Rights Under the FDCPA

Over forty years ago, Congress passed the Fair Debt Collection Practices Act, or FDCPA, which prohibits debt collectors from using harassing and manipulative tactics like the ones below to get your money:

  • Make threats they cannot legally carry out or have no intention of carrying out
  • Use profane or obscene language
  • Demand outrageous amounts that exceed the amount of the original debt
  • Call you outside of the 8:00 a.m. – 9:00 p.m. time frame in your time zone
  • Discuss the debt with anyone except you, your spouse, attorney and any co-signers
  • Pretending to be police officers or government agents

Plaintiff vs. Delta Outsource Group, Inc. et al*

According to PACER, in or around the fall of 2014 Delta Outsource Group, Inc. started trying to collect a debt from a New York resident.

She later complained that the messages left on her voicemail did not properly disclose the caller’s identity as a debt collector trying to collect a debt.

One message the Plaintiff received on or around October 29, 2014 allegedly stated in sum and substance that she was to call Shay from Delta Outsource Group at 1-800 364-1895. At the time she received it, she did not know that it was a debt collection attempt.

Feeling harassed by Delta Outsource Group, Inc., the Plaintiff hired a consumer attorney and filed a class action lawsuit against the company for allegedly violating the FDCPA in the following ways:

  • Failing to identify itself as a debt collector in all communications
  • Using false, deceptive, and misleading means to collect a debt

The matter was later settled.
