According to PACER, in or about mid-2016, a Louisiana resident started receiving collection calls from Delta Account Systems, Inc. Messages left on his voicemail allegedly failed to identify themselves as a debt collector seeking to collect a debt.
For example:
Yeah, [Plaintiff], this is Randy Mitchell. If you would, give me a call. This is 318-741-1290. That’s 318-741-1290. If you could, [Plaintiff], make sure to return my call. This is Randy Mitchell. It’s important. Thank you.
During one conversation, a collector allegedly told the Plaintiff that an attorney was on the other line and giving instructions regarding filing suit on his account and that the only way to stop the filing that afternoon was to pay the account in full immediately.
When the Plaintiff asked if he could have a written explanation of the amounts that he owed Delta, the collector allegedly said, “We’re not gonna play that game with you.”
Feeling harassed by Delta Account Systems, Inc., the Plaintiff hired a consumer attorney and sued the company for allegedly violating the FDCPA in the following ways:
- Using false, deceptive, and misleading means to collect a debt
- Threatening legal action it was not in a position to take
- Using harassing and abusive means to collect a debt
