Are You Being Called By the Law Offices of D. Scott Carruthers?

When we experience an unexpected financial setback, monthly debt that was once routine can overwhelm us. Eventually, debt collectors will start calling, and they can be ruthless when it comes to getting your money. It’s important to remember, however, that you have rights no matter how much you owe.

Your Rights Under the FDCPA

Prior to 1977, consumers were declaring bankruptcy simply to escape harassment by debt collectors. Congress responded by passing the Fair Debt Collection Practices Act, or FDCPA, which prevents collection agencies from using methods like the following to collect or attempt to collect a debt.

● Using profane and obscene language
● Pretending to be police officers or federal agents
● Telling your friends, neighbors and co-workers that you owe money
● Attempting to collect a debt that is in dispute
● Telling you that you can be arrested if you don’t pay a debt
● Failing to identify themselves as debt collectors
