According to PACER, on or about December 28, 2011, a representative from Creditors Collection Service, Inc. allegedly called a Wisconsin consumer, claiming to be an attorney hired by the agency. This caller allegedly threatened to take the consumer and her husband to court.

The amount of the alleged debt was $658.39. On or about January 9, 2012, the creditor filed a lawsuit against the consumer and n or about February 21, 2012, the consumer went to the agency’s office to pay the debt, which totaled $658.39.

Company representatives informed her that she owed a total of $1,109.91, with collection fees and other costs included. She was shocked but felt she had no choice but to pay it.

Feeling harassed by Creditors Collection Service, Inc., the consumer hired an attorney and sued the company for allegedly violating her rights by:

  • Falsely claiming to be an attorney
  • Using false, deceptive, and misleading means to collect a debt
  • Using unfair and unconscionable means to collect a debt
  • Misrepresenting the character, amount, or legal status of a debt

A judge later ruled in favor of the plaintiff.
