Are You Being Called By Credit Solutions, LLC?*

Perhaps you owe the debt but cannot afford to pay it. Or maybe you dispute the amount and refuse to pay it. In some cases, the debt is not even yours. None of it really matters.

The debt collector continues to harass you because they want your money. If they don’t stop, you can recover damages for the harm they have caused you.

Your Rights Under the FDCPA

A consumer protection law called the Fair Debt Collection Practices Act (FDCPA) gives you the right to tell a collection agency to stop contacting you and sue them if they ignore you. You can also sue a debt collector that uses tactics like those below to get you to pay.

  • Calling you at any inconvenient place or time, including before 8:00 a.m. or after 9:00 p.m.
  • Using profane and obscene language
  • Accusing you of having committed a crime
  • Threatening you with violence
  • Calling you at work if your employer prohibits such conduct
  • Threatening you with lawsuits they have no intention of filing

Alleged Violations against Credit Solutions, LLC

According to PACER, on or about March 21, 2002, Credit Solutions, LLC sent a collection letter to a New York consumer. The letter offered a special one-time only payment arrangement but stated that he had to take advantage of it before April 30, 2002.

This offer appeared to contradict his right to dispute and seek verification of the debt.

Feeling harassed by Credit Solutions, LLC, the consumer filed a lawsuit against the company for allegedly violating his rights in the following ways:

  • Using false, deceptive, and misleading means to collect a debt
  • Sending him a letter that appeared to violate his dispute rights

The matter was later dismissed.
