Alleged Violations against CMG Recovery Services, LLC*

According to information on the PACER website, in or around June 2009, CMG Recovery Services, LLC started calling a Minnesota consumer to collect a debt. When he disputed the debt, one caller allegedly cursed and yelled at him and told him that his own family called him a deadbeat.

When the call terminated, the agency allegedly called him back using a telephonic code so that his caller ID displayed that the incoming call was from his parents. When the consumer answered, the caller allegedly swore and yelled at him again.

The consumer also alleged that on another occasion, collectors called his friend and stated that the friend was mandated by law to immediately provide location information for him. When the friend declined, the caller allegedly yelled obscenities and revealed details about the debt.

Feeling harassed by CMG Recovery Services, LLC, the consumer hired a lawyer and filed a lawsuit against the agency for:

  • Using profane and obscene language
  • Misrepresenting the character, amount, or legal status of a debt
  • Using false, deceptive, and misleading means to collect a debt
  • Disclosing information about the debt to third parties
  • Using harassing and abusive means to collect a debt
  • Using unfair and unconscionable means to collect a debt

The matter was later settled.
