It opened for business in 2006, has fewer than 10 employees, and is managed by Steve McPherson. Public records archived at the PACER website indicate that consumers who believed that they were being harassed by Claims America, LLC took the agency to court and won compensation.

Alleged Violations against Claims America, LLC*

According to information on the PACER website, in or around February 2008, Claims America, LLC allegedly started trying to collect a debt from a Pennsylvania consumer by calling constantly and threatening to sue him if he didn’t pay. He finally agreed to settle the debt for over $3,000. When accepting the settlement, the agency sent him a letter suggesting that it had already received a judgement against him for over $10,000.

In January 2009, Claims America, LLC tried to collect a charged-off Discover Card debt by calling a Maryland consumer’s mother and leaving a detailed voicemail about the debt. When the consumer called back and said that the debt was time-barred, a collector allegedly told her that the deadline was reset when new collection efforts began and threatened to send the sheriff over unless she settled the debt, so she did.

However, when it was allegedly represented that a judgement had been received against her, she disputed the debt. Her dispute was allegedly followed by a call from a collector who identified himself as a “special investigator for RSI.”

Feeling harassed by Claims America, LLC, the consumers sued the agency for:

  • Misrepresenting the character, amount, or legal status of a debt
  • Using false, deceptive, and misleading means to collect a debt
  • Disclosing information about the debt to third parties
  • Using harassing and abusive means to collect a debt
  • Using unfair and unconscionable means to collect a debt
  • Threatening action it cannot legally take

A judge awarded each consumer $1,000 plus attorney fees.
