Alleged Violations against the Cherrington Firm, LLC

According to PACER, on or around July 5, 2016, the Cherrington Firm, LLC served a summons and complaint on a Utah consumer to collect a medical debt. He alleged that the complaint did not accurately itemize the various charges and payments that comprised the total amount of the alleged debt, identify whether any amount due included a collection fee, or identify the payment his insurance made toward the alleged debt.

A pretrial conference took place on February 6, 2017. The consumer alleged that the Cherrington Firm, LLC did not notify the court that negotiations were taking place, and represented to the court that they were entitled to a default judgment as a result of his failure to appear.

Feeling harassed by the Cherrington Firm, LLC, the consumer got a free case review from a consumer lawyer before filing suit for:

● Failing to clarify the various components of the debt
● Using deceptive means to collect a debt

The matter was later settled.
