Alleged Violations against Capital Credit Solutions

According to PACER, in or around October 2011, Capital Credit Solutions called a Michigan consumer and allegedly claimed to be a law enforcement officer. After allegedly being threatened with legal action over an old alleged payday loan, he made a credit card payment of $200.00 on October 17, 2011.

However, two more charges of $150 and $149 were made on his card on October 31, allegedly without his permission.

Feeling harassed by Capital Credit Solutions, the consumer filed a lawsuit against the agency for the following alleged FDCPA violations:

  • Using harassing and oppressive means to collect a debt
  • Using any false, deceptive, or misleading representation or means in connection with the collection of a debt
  • Threatening actions that could not legally be taken
  • Pretending to be a law enforcement officer
  • Trying to collect an amount not permitted by law or the original creditor agreement

A judge ordered Capital Credit Solutions to pay the plaintiff $1,000 in statutory damages, $1,825 in attorney fees, and $350 in costs, for a total of $3,175.
