Are You Being Called By Brent D. Stamps?*

Are you being called by Brent D. Stamps?* Here’s what you need to know

When financial setbacks cause you to fall behind in your monthly bill payments and the accounts are assigned to a third-party collection agency, your problems can get worse. Many debt collectors are known for rude, abusive, and otherwise unethical conduct. However, don’t let stress cause you to forget that you have rights and protections under the law.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, limits what third-party debt collectors can say or do when contacting you about a debt you allegedly owe. If they use methods like those below to intimidate you into paying in full, they’re breaking the law.

  • Using profane and obscene language
  • Calling you before 8:00 a.m. and after 9:00 p.m. in your time zone
  • Calling you at work after you’ve told them that your workplace doesn’t allow such calls
  • Failing or refusing to validate the debt
  • Using the phone to harass you by calling nonstop or using an autodialer
  • Talking about the debt to anyone except you, your spouse, or your attorney

Alleged Violations against Brent D. Stamps

According to PACER, on October 9, 2015, Brent D. Stamps, on behalf of his client, Piedmont Healthcare, Inc., filed a collection lawsuit against a Georgia resident. The documents were served on the resident’s on November 3, and soon afterwards the action was dismissed, but Mr. Green later claimed that the the language in the notice that was served upon him deviated substantially from the statutory requirements and even included a false business name, “Law Office of Brent D. Stamps, LLC”, which was allegedly not a legal entity organized in Georgia or otherwise authorized to operate in Georgia.

Feeling harassed by Brent D. Stamps, the Georgia resident hired a consumer attorney and sued him for allegedly violating the FDCPA by using false, deceptive and misleading means to collect a debt.

The matter was later dismissed.
