Stop the

You have legal rights. We can help.

When you’re barely able to make ends meet, the last person you want to hear from is a debt collector. It’s stressful enough to go through your day without being yelled at and belittled, but if it does happen to you, you can make it stop.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, protects consumers like yourself from debt collectors who assume that you don’t have rights because you owe money. Actions like those below can get an agency shut down.

  • Harassing you over a debt that isn’t yours
  • Leaving voice messages that do not identify them as debt collectors
  • Failing to report your dispute to the credit bureaus
  • Adding illegal service fees to the original debt
  • Calling your relatives and friends about the debt
  • Shouting at you over the phone

Alleged Violations against Brachfeld & Associates*

According to PACER, in or around mid-2009, Brachfeld & Associates began contacting a California consumer to collect a debt. She claimed that the firm’s collectors called her at least twice a day and threatened to serve her with a summons. She also complained that calls came in from an unknown number, sometimes after 9:00 p.m., and that she had never received a debt verification package

Feeling harassed by Brachfeld & Associates, the consumer sued the agency for:

  • Harassing her by phone
  • Using harassing means to collect a debt
  • Threatening legal action it did not intend to take
  • Not validating the debt

The case was later resolved.
