According to PACER, on or around March 10th, 2016 Betz-Mitchell Associates, Inc. sent a collection letter to a New York consumer demanding a “Balance Due” of $97.35.

The “Balance Due” in this case was for an amount that included original principal and contractual interest, and the letter did not indicate that the balance could increase due to accumulating interest.

Feeling harassed by Betz-Mitchell Associates, Inc., the consumer took the company to court, claiming that it had used false, deceptive and misleading means to collect a debt. The matter was later dismissed.
