Being Called By Best Egg? Here’s What You Need to Know

With over 17.8 million people unemployed due to COVID-19, it’s not surprising that debts go unpaid. Overdue medical bills, credit cards, and other debts can enter collections when they become more than 180 days past due, and not all debt collectors are polite when collecting them.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act was passed in 1977, but abuses are still evident over 40 years later. This appears to be because debtors unfamiliar with their rights give in to make the bullying stop, unaware that tactics like the following are illegal:

  • Telling your friends and family that you owe a debt
  • Calling you names like loser or deadbeat
  • Using the phone to harass you
  • Pretending to be police officers or government agents
  • Calling you at work
  • Using abusive language

Alleged Violations against Best Egg

According to PACER, in or around May 2018, Best Egg called a Florida consumer to collect a debt related to a personal loan he had taken out with them. He said that May 2, 2018 and September 11, 2018, the company called his cell phone 225 times to harass him into paying.

Feeling harassed by Best Egg, the consumer took the company to court for:

  • Harassing him by phone
  • Calling him after being asked to stop

The matter was later settled.
