Your Rights Under the FDCPA

In 1977 Congress passed the Fair Debt Collection Practices Act, or FDCPA. This consumer protection law gave indebted consumers the right to dispute a debt and made it illegal for third-party debt collectors to use pressure tactics like those below:

  • Calling at unreasonable and inconvenient hours
  • Using obscene or profane language
  • Threatening action they are not in a position to legally take
  • Contacting you after you have formally requested that all communications cease
  • Calling you before 8:00 a.m. and after 9:00 p.m. in your time zone
  • Reporting false information to the credit bureaus

BCA Financial Services is a debt collection company located in Palmetto Bay, Florida. It was established in 1956, has approximately 135 employees, and is managed by its President, Pamela Kirchner.

Records on file at the PACER (Public Access to Court Electronic Records) website indicate that many consumers who believed they were being harassed by BCA Financial Services refused to pay debts they did not owe or could not afford.

Alleged Violations against BCA Financial Services

According to PACER**, in May 2015 a Florida resident received a collection letter from BCA Financial Services that demanded payment of a medical debt she had already settled with the original creditor.

Despite her insistence that she did not owe it, the agency allegedly sent another demand letter the following month.

Feeling harassed by BCA Financial Services, she hired a consumer attorney and sued the company for allegedly violating the FDCPA by using false, deceptive and misleading means to collect a debt.

The matter was later closed.
