Stop The Harassment

You have legal rights. We can help.

If debt collectors are contacting you all the time, you may feel like declaring bankruptcy to get relief from all the harassment. Although this can be a feasible option when your debt level is out of control, you should also get a free case evaluation from a consumer attorney because it is illegal for collection agencies to harass consumers.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act (FDCPA) controls how debt collectors may interact with consumers while trying to collect a legitimate debt. Specifically, they must avoid using underhanded or abusive tactics like those listed below:

  • Using profane and abusive language
  • Demanding illegal service fees
  • Telling you that you can be sent to prison if you don’t pay
  • Calling at all hours of the day and night
  • Ignoring your dispute letter
  • Calling you at your workplace

Alleged Violations against Bayside Capital Services, LLC

According to PACER, in or around April 2019, Bayside Capital Services, LLC began calling a Texas consumer to collect a payday loan. She claimed that on April 23, a collector called her workplace and told her co-worker to have her call them back about a debt. Another call was allegedly placed to her father.

The consumer called Bayside Capital Services, LLC and asked why her family members were being called and how her father’s number was obtained. She was allegedly told that the agency got his number by checking her social security number. A representative then allegedly demanded that she make a payment of $700, although the original debt was only $300.
The consumer told the company to stop calling her, but she continued to receive calls on her cell phone, apparently from an autodialer.

Feeling harassed by Bayside Capital Services, LLC, the consumer took the agency to court for:

  • Mentioning her debt to her family and colleagues
  • Calling her workplace
  • Harassing her with an autodialer

The matter was later settled.
