Diane Hertzog vs. Adams & Morse Associates, Inc. et al*
According to PACER, on or around December 14, 2004, Pennsylvania resident Diane Hertzog began receiving collection calls from Adams & Morse Associates, Inc. at her workplace. Although she told the caller, who identified himself as ‘Sonny’, that her employer prohibited such communications, the calls allegedly continued. At one point Sonny allegedly responded, “I’ll call you everyday at work and at home until the bill is paid.” During a call on or about December 16, 2004, he allegedly told Ms. Hertzog that if she failed to pay within thirty days, her driver’s license would be suspended. Later, he allegedly left voice messages for her supervisor.
Feeling harassed by Adams & Morse Associates, Inc., Ms. Hertzog hired a consumer attorney and sued the company for allegedly violating the FDCPA in the following ways:
- Using false, deceptive, and misleading means to collect a debt
- Using harassing and abusive means to collect a debt
- Calling her at work although such calls were prohibited by the employer
The matter was later dismissed.
