According to PACER, on or around June 14, 2019, American Credit Financial, LLC allegedly called a California consumer and left a voice message stating that he had a legal matter pending against him regarding an outstanding debt. When the consumer returned the call and said he was unable to pay, a collector allegedly responded, “You have to pay this debt no matter what.”

When the consumer reiterated that he was unable to make a payment, the collector allegedly said that the company would take him to court and that he would be liable for $9,000 in debt and attorneys’ fees.
Feeling harassed by American Credit Financial, LLC, the consumer fought back by suing the agency for:

  • Demanding payment during the dispute period
  • Using abusive collection methods
  • Threatening legal actions it could not take
