Is A&S Collection Associates, Inc calling you? Protect yourself from harassment!

If you are being harassed by debt collectors seeking money you are likely feeling stressed and unsure of what to do. You may want to do nearly anything to get the harassment to stop, including filing personal bankruptcy.

Don’t let a debt collector push you to take such a drastic step: no matter how much you owe, you have rights.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, is a consumer protection law that limits what third-party debt collectors can say or do when communicating with you about a debt they have been assigned to collect.

Since 1977, when the law was enacted by Congress, using pressure tactics like the following have been illegal.

  • Using profane and obscene language
  • Contacting you at an inconvenient or unusual time and place, such as early in the morning, late at night
  • Contacting you if the debt collector is aware that you are being represented by an attorney
  • Threatening to ruin your credit if you don’t pay
  • Pretending to be attorneys or police officers
  • Threatening legal action they are not eligible to take or have no intention of taking

During the first of these calls, Mr. Yarra informed the collector that he disputed the debt and requested that validation be sent to him.

A&S Collection Associates Inc allegedly never sent the debt validation to him.

During this same call, the collector allegedly belittled and threatened Mr. Yarra by asking if he was a millionaire and if he was, he should just pay the debt before it was reported to a credit bureau.

The collector also allegedly stated that his credit scores would decrease if he failed to pay the debt.

Soon afterward, A&S Collection Associates Inc allegedly sent a letter threatening to report the account to Equifax Credit Bureau and warned that legal action would be forthcoming. In response, Mr. Yarra sent a letter disputing the debt and asking for its validation.

In or about May, 2012, A&S Collection Associates Inc allegedly contacted him again. During the conversation, the collector allegedly threatened to ruin his credit, and when Mr. Yarra stated that he was hiring a lawyer, the collector allegedly asked how he could afford a lawyer when he could not even afford to pay a small debt.

They further allegedly demanded that he get his credit card out immediately and pay it.
