Has FH Cann & Associates, Inc. Called Repeatedly?*

Unfortunately there are times when debt becomes a reality because of personal circumstances that cannot be predicted, so you may not have been able to repay a debt by the specified deadline. The creditor may not be happy about this and might try to recover the debt by using FH Cann & Associates, a debt collector, who may be prepared to try to collect the debt for them.

Falling into debt may not happen through choice, but no one wants to be contacted repeatedly by a debt collector as this can be a frightening and intimidating experience. Fortunately, the U.S. federal government does not allow any third party debt collector to try and obtain a debt through undue pressure like unwanted visits or calls on the debtor.

What is the FDCPA?

The Federal Debt Collection Practices Act (FDCPA) is the legislation which regulates what activities of debt collection agencies like FH Cann & Associates are permitted to do. The FDCPA does not have the capacity to exclude a debtor from repaying a debt but it does help to stop a third party debt collector from harassing debtors about their debt. It also stops debt collectors from taking part in any form of abusive activity that is directed at the debtor. If a debt collection company like FH Cann & Associates does not act responsibly as specified by the FDCPA the debtor may have the right to sue the debt collector as long as it takes place within 12 months of its violation of the law.

What is and What is Not Acceptable Behavior for FH Cann & Associates

FH Cann & Associates is a debt collection service. It is paid to recover debts from those debtors who have fallen into debt due to failure to pay back what they owe in a set time frame. The creditor is in its rights to hire a debt collection company to recover debts owed to it but the debt collector is not given the authority to harass the debtor in antisocial hours. These are considered to be before 8 in the morning and after 9 at night, unless prior arrangement has been made.

What to Do if Harassed by FH Cann & Associates

The obvious thing to do is to tell the debt collector that they should not contact you when you are at home or by phoning you unless you have given them permission to do so. If the debt collector won’t stop making contact or uses any sort of threatening or abusive language to try to recoup the debt you may be able to take legal action against them. You have 12 months to file a damages claim from the date the harassment began.

How an Attorney can Help

You can take legal action on your own against FH Cann & Associates but, in the end, the claim is far more likely to be successful if you hire an attorney to work on your behalf. The attorney will be able to make a quick decision whether you have sufficient proof that the debt collector has acted inappropriately and whether you are likely to win a successful claim.
