Teela Lloyd vs. Mauconduit & Luna, LLC et al*
According to PACER, in or around June 2011, Mauconduit & Luna, LLC started trying to collect a debt from Pennsylvania resident Teela Lloyd. She later complained that the agency called her more than 20 times a month and even left a voice message on the answering machine of her boyfriend’s father. The message allegedly accused her of “writing out fraudulent checks and signing his name.” The caller, who identified himself as Victor Gage, asked the father to return the call and help the agency find Ms. Lloyd so his name could be removed from the checks.
When Ms. Lloyd returned the call, Mr. Gage allegedly told her that what she was doing was wrong and that she would be picked up and taken to jail if she did not honor the “bad checks”. When she denied writing any checks, he transferred her to a woman who allegedly identified herself as an attorney and advised Ms. Lloyd to provide a Visa card number so that she would look “tangible” in court and prevent the police from taking her to jail.
In July 2011 Mr. Gage allegedly called Ms. Lloyd’s home and told her seven-year-old daughter that if she did not take a message, her mommy would be going to jail.
Feeling harassed by Mauconduit & Luna, LLC, Ms. Lloyd hired a consumer attorney and sued the company for allegedly violating the FDCPA by:
- Disclosing her alleged debt to third parties
- Calling her at times and places known to be inconvenient
- Using abusive and oppressive means to collect a debt
- Threatening legal action they did not intend to take
- Using false, deceptive, and misleading means to collect a debt
- Failing to identify themselves as debt collectors in all communications
- Failing to send her debt validation information
