Are you being called by Amsher Receivables Management, Inc.?* Here’s what you need to know.
Debt collectors frequently go too far when it comes to settling accounts, if the volume of complaints to the Federal Trade Commission is any indication. Some embarrass you by calling your family and boss while others deliberately re-age accounts so that they can chase you for a time-barred debt. If this happens to you, be prepared to act on your rights.
Your Rights Under the FDCPA
The Fair Debt Collection Practices Act (FDCPA) has strict guidelines in place regarding how third-party debt collectors can approach you about paying an account. Actions like those below are illegal when used to collect a debt.
- Calling at inconvenient times, such as before 8:00 a.m. and after 9:00 p.m. in your time zone
- Threatening consequences they cannot legally inflict, or have no intention of carrying out
- Calling you at work if they know or have reason to know what such calls are not allowed
- Reporting false information to the credit bureaus
- Threatening to call your payroll department and tell them you owe a debt
- Refusing to provide proof that a debt even exists and that they are authorized to collect it
